Legal Status

 

 

Colorado Revised Statute 22-80-102 establishes CSDB as one of the educational institutions of the state of Colorado for the purpose of educating children of the state who, by reason of the impairment of their sense of hearing or of sight, cannot be advantageously educated in other school or educational institutions of the state.  In addition to providing a residential school program, the statute mandates CSDB to be a resource to school districts, state institutions, and other agencies.

 

State law provides that CSDB shall be governed by a board of trustees as a “Type 1” agency within the Colorado Department of Education (“CDE”).  CSDB’s Board of Trustees is appointed by the governor and has those powers, duties and functions specifically vested by state statute.  Thus, the Board of Trustees has the authority to operate independently from CDE regarding its statutorily prescribed powers and duties.  Those powers, duties and functions not specifically delegated to the Board of Trustees by statute shall be under the supervision of CDE’s Commissioner of Education.
