Board Membership
Appointments
The Board of
Trustees shall consist of seven members who are residents of
In making
appointments to the Board, the Governor shall give due consideration to
establishing and maintaining a geographical and urban and rural balance among
Board members.
No more than four of the seven members shall be members of the same
political party. The commissioner of
education or his or her designee shall serve as an ex officio nonvoting member
of the Board.
The terms of
office of Board members shall be four years.
However, of the members initially appointed in 2004, four members shall
serve four-year terms and three members shall serve two-year terms, as
designated by the Governor.
Removal from office
The Governor
may remove any Board member from the Board of Trustees for misconduct,
incompetence, or neglect of duty.
For purposes of
this policy, the Board shall consider “neglect of duty” to include but not be
limited to a Board member’s failure to attend three consecutive meetings of the
Board, unless the Board by resolution approves any additional absences or
unless such absences are due to temporary mental or physical disability or
illness. The Board may at any time adopt
a resolution declaring that a Board member has engaged in misconduct,
incompetence, or neglect of duty and recommending that the Governor remove the
Board member and declare a vacancy on the Board. The Board or its designee shall then provide
this resolution to the Governor’s office for the Governor’s consideration.
Vacancies
The Governor
shall fill all vacancies that occur on the Board.
When a Board
member resigns or a vacancy otherwise occurs on the Board, the Board shall
notify the Governor’s office regarding the Board vacancy as soon as reasonably
possible. The Board may choose to adopt
a resolution regarding the Board’s recommended

appointee(s) to the Board. Any recommended appointee(s) shall be in
accordance with the criteria set forth in state law. The Board or its designee shall then provide
such resolution to the Governor’s office for the Governor’s consideration.
